01 About FishSignal

FishSignal is a fishing intelligence and forecasting service designed to help users evaluate fishing conditions using environmental, weather, marine, biological, and other relevant data.

The Service may provide information such as weather conditions, wind, waves, water temperature, atmospheric pressure, lunar and solar data, fishing conditions, species information, estimated fish activity, fishing forecasts, recommendations, and other analytical information.

FishSignal is provided for informational and recreational purposes only.

02 Eligibility

You must be legally capable of entering into a binding agreement under the laws applicable to you in order to use the Service.

If you use FishSignal on behalf of a company or other organization, you represent that you have authority to accept these Terms on its behalf.

03 Accounts

Some features of the Service may require an account.

You are responsible for maintaining the confidentiality of your account credentials and for all activity performed through your account.

You agree to provide accurate information when creating or maintaining your account and to keep that information reasonably up to date.

You must notify us promptly if you believe your account has been accessed or used without authorization.

We reserve the right to suspend or terminate accounts that violate these Terms, are used fraudulently, or pose a risk to the Service or other users.

04 Fishing Forecasts and Data

FishSignal uses data, models, algorithms, third-party data sources, and other analytical methods to generate forecasts, scores, estimates, and recommendations.

Fishing conditions are inherently unpredictable. FishSignal does not guarantee:

• that fish will be present at a particular location;
• that a particular species will be active;
• that you will catch fish;
• the accuracy of predicted fish activity;
• that environmental conditions will match a forecast;
• that any particular fishing location will be accessible, legal, or safe.

Forecasts and recommendations should be treated as estimates rather than statements of fact.

Actual conditions may differ significantly from those displayed by the Service.

05 Weather, Marine Conditions, and Safety

Weather, wave, wind, current, tide, water temperature, and other environmental information available through FishSignal may originate from third-party providers or predictive models and may contain errors, delays, inaccuracies, or incomplete information.

FishSignal is not an emergency, navigation, maritime safety, or weather warning service.

Do not rely on FishSignal as your sole source of information when making decisions that may affect your health or safety.

Before fishing, boating, entering the water, traveling to remote locations, or participating in other potentially hazardous activities, you should independently verify current conditions using appropriate official or professional sources.

You are responsible for assessing local conditions and determining whether an activity is safe.

06 Fishing Regulations

Fishing laws and regulations vary by country, region, species, season, fishing method, and location.

You are solely responsible for complying with applicable laws and regulations, including requirements relating to:

• fishing licenses and permits;
• protected species;
• minimum and maximum fish sizes;
• catch and possession limits;
• closed seasons;
• restricted or protected areas;
• permitted fishing methods and equipment.

Information provided by FishSignal regarding regulations, where available, is informational only and should not be considered legal advice or an authoritative statement of current law.

07 Subscriptions and Paid Services

FishSignal may offer free and paid plans.

The features, usage limits, pricing, and billing period applicable to a paid plan will be displayed before purchase.

By purchasing a subscription, you authorize the applicable payment provider to charge the displayed subscription price and any applicable taxes using your selected payment method.

Unless otherwise stated during checkout, subscriptions automatically renew at the end of each billing period until canceled.

You may cancel your subscription at any time. Cancellation prevents future renewals but does not normally terminate access to paid features for the billing period that has already been paid.

08 Price Changes

We may change subscription prices from time to time.

Any price change affecting an existing recurring subscription will apply to a future billing period and will be communicated or displayed as required by applicable law.

If you do not agree to a price change, you may cancel your subscription before the new price takes effect.

09 Refunds

Refund eligibility is described in our Refund Policy and may also be subject to mandatory consumer protection laws applicable to you.

Nothing in these Terms limits any refund, cancellation, withdrawal, or other consumer right that cannot legally be excluded or restricted.

10 Payment Processing

Payments may be processed by third-party payment service providers.

FishSignal may not directly receive or store your complete payment card information. Payment providers process payment information according to their own terms and privacy policies.

Your purchase may therefore also be subject to the terms of the payment provider used during checkout.

11 Acceptable Use

You may use FishSignal only for lawful purposes and in accordance with these Terms.

You must not:

• use the Service for unlawful or fraudulent purposes;
• attempt to gain unauthorized access to the Service, accounts, servers, or systems;
• interfere with or disrupt the operation or security of the Service;
• bypass subscription restrictions, access controls, or usage limits;
• use automated systems to scrape, extract, copy, or systematically collect data from the Service without our permission;
• reverse engineer or attempt to obtain source code except where such restriction is prohibited by law;
• reproduce or commercially redistribute substantial portions of FishSignal data, forecasts, or content without authorization;
• use the Service in a manner that could damage, overload, or impair its operation.

We may restrict or suspend access where reasonably necessary to protect FishSignal, its users, or third parties.

12 Intellectual Property

The FishSignal Service, including its software, design, branding, interfaces, original text, graphics, databases, algorithms, scoring systems, and other original materials, is owned by or licensed to FishSignal and is protected by applicable intellectual property laws.

Except as expressly permitted by these Terms, using the Service does not grant you ownership of or rights to FishSignal intellectual property.

You receive a limited, non-exclusive, non-transferable, revocable right to access and use the Service for its intended purpose while you comply with these Terms.

Third-party data and content remain the property of their respective owners and may be subject to separate terms or licenses.

13 Third-Party Services and Data

FishSignal may rely on or integrate with third-party services, APIs, data providers, maps, weather services, marine data providers, payment processors, or other external services.

We do not control these third-party services and cannot guarantee their continuous availability, accuracy, completeness, or performance.

Features dependent on third-party services may become unavailable, delayed, modified, or discontinued.

14 Service Availability and Changes

We aim to provide a reliable Service, but we do not guarantee uninterrupted or error-free availability.

The Service may occasionally be unavailable because of maintenance, technical problems, third-party outages, infrastructure failures, updates, or circumstances outside our reasonable control.

We may modify, add, remove, or discontinue features of the Service. Where required by applicable law, we will provide appropriate notice of material changes affecting paid services.

15 Disclaimer of Warranties

To the maximum extent permitted by applicable law, FishSignal is provided on an “as is” and “as available” basis.

We do not warrant that the Service will always be available, accurate, complete, current, secure, or error-free.

In particular, we make no guarantee regarding the accuracy or outcome of fishing forecasts, fish activity predictions, weather forecasts, marine forecasts, environmental data, or recommendations.

Nothing in this section excludes warranties or rights that cannot legally be excluded under applicable consumer protection law.

16 Limitation of Liability

To the maximum extent permitted by applicable law, FishSignal and its owners, operators, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, or similar damages arising from or related to your use of or inability to use the Service.

This includes, without limitation, losses resulting from reliance on fishing forecasts, weather or marine information, fishing recommendations, third-party data, service interruptions, or loss of data.

You remain responsible for decisions you make based on information provided through the Service.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law, including liability that cannot legally be excluded or limited.

17 Privacy

Our collection and use of personal information are described in our Privacy Policy.

By using the Service, you acknowledge that your information will be handled as described in that policy and in accordance with applicable data protection laws.

18 Suspension and Termination

You may stop using FishSignal at any time.

We may suspend or terminate access to the Service if you materially violate these Terms, use the Service fraudulently or unlawfully, create security risks, or abuse the Service.

Where appropriate and reasonably possible, we may provide notice or an opportunity to correct a violation before termination.

Termination does not affect obligations or rights that by their nature should survive termination.

19 Changes to These Terms

We may update these Terms from time to time to reflect changes to the Service, our business, applicable laws, or regulatory requirements.

If changes materially affect your rights or obligations, we will provide additional notice where required by applicable law.
